        <![CDATA[<p>Nadya Suleman, who is better known as the octomom, has reportedly filed for bankruptcy. In her Chapter 7 filing, the mother of 14 has listed debts of $1 million against assets of just $50,000. Her creditors include DirectTV, a private school that several of her children attend, and her father, among others. It's a case being watched in Texas and around the world.</p>
<p><a href="http://www.maidalawfirm.com/Bankruptcy/Chapter-7-Bankruptcy-Liquidation.shtml" target="_blank">Chapter 7 bankruptcy</a> is an important tool available to indebted individuals across the country, including here in Texas. It allows a person to relinquish their debt, giving them the opportunity to gain a fresh start in life. However, it is not for everyone. In Chapter 7, many of a debtor's assets are liquidated so as to satisfy the claims of creditors. But for someone who is deep in debt, it may well be a breath of fresh air.</p>]]>
        <![CDATA[<p>That appears to be the case for Suleman. With so few assets and such a huge burden of debt, it may be difficult to devise a repayment plan that would put her on the path toward financial independence. Through Chapter 7, though, she will likely be offered a clean slate.</p>
<p>Additionally, Chapter 7 may be able to prevent foreclosure. Suleman and her 14 children are currently residing in a four-bedroom home, for which she has fallen $30,000 behind in payments. A foreclosure auction had been scheduled for the residence, but it has reportedly been postponed.</p>
<p>There are many reasons why a person may find themselves so deeply in debt. While Suleman represents an extreme case, many Texas residents have no doubt shared the experience and pain of her financial distress. For those who are falling behind in their financial obligations, Chapter 7 bankruptcy may well provide them with the opportunity they need to start anew.</p>

        <![CDATA[<p>Texas readers may have heard the depression-era joke that some people were so broke after the stock market crash in 1929, they could only commit suicide by jumping up from their basement apartments.</p>
<p>These days, individuals and families facing bankruptcy may have some of those same feelings, especially after hearing that a <a href="http://www.maidalawfirm.com/Bankruptcy/Chapter-7-Bankruptcy-Liquidation.shtml" target="_blank">Chapter 7 bankruptcy</a> proceeding typically costs about $1500. That's because Congress amended the laws through the 2005 Bankruptcy Abuse Prevention and Consumer Protection Act.</p>]]>
        <![CDATA[<p>In an effort to cut down on bankruptcy filings, Congress raised fees and added additional paperwork and even required credit counseling and debtor education. Those amendments have given rise to the sentiment today that some people are too broke to even afford bankruptcy.</p>
<p>To be sure, the filing fee was raised to $300, although it may be waived upon request if the filer is within 150 percent of the poverty income level. Then there's credit counseling, said to cost an average of about $85. Beyond that there are legal fees, pushed necessarily higher because of the additional work involved to comply with the added requirements under the 2005 law.</p>
<p>An interesting trend has developed this year. It appears that more and more taxpayers in Texas and elsewhere are using their state and federal tax refunds to fund their Chapter 7 and related bankruptcy petitions. Statistics show a definite spike in filings around the time that taxpayers typically receive their refunds.</p>
<p>Consumer debt educators offer the advice that those who file for bankruptcy would be best served by being sure that it's done right the first time. That's because improperly filed petitions risk being dismissed by the court for failing to meet requirements. If that happens, it will likely have a negative impact on the filer's credit without the benefit of a release from debts that is possible with a correctly filed petition.</p>

<p>The attorney general in another state revealed tactics used by a debt collector that included imbedding debt collectors in hospitals, some of which almost seemed like medical staff, and had access to patient information. This is the latest effort by companies trying to collect money, and it may not be an isolated incident.</p>]]>
        <![CDATA[<p>In no way should a debt collector have access to patient information. If someone owes a medical debt, they shouldn't be bombarded in their hospital room, where they are seeking care for a potentially devastating illness or injury.</p>
<p>The attorney general who released her findings also said that at times the people using these tactics didn't identify themselves as debt collectors. This means they could have been collecting information from the patients illegally. While many of these tactics are extreme, it seems that debt collection agencies don't care about how they get the money, just as long as they get it.</p>
<p>These illegal tactics might be working, too. The company that is accused of the bedside debt collecting reported a 130 percent increase in profit last year. It is important that patients seek out help if they are being harassed for debt that they might own. Legal measures can be put in place to try to help deter or stop collectors from harassing people.</p>

        <![CDATA[<p>The FTC says these companies operate using fraud. They target consumers who submitted personal identification information when applying for payday loans. The companies then had people in India call to ask for money that was owed, when in fact the people didn't owe anything.</p>
<p>The investigation into the fraudulent debt collection calls is in its early stages and the FTC isn't sure how the company involved obtained the personal information. The people applied for payday loans with legitimate companies, which suggest that the information was stolen.</p>
<p>Some people are confronted with debt collection calls from multiple creditors. They may easily lose track of who they owe and how much they owe. Receiving a fraudulent call when they are working to pay off creditors can leave some people victims of fake collection calls.</p>
<p>Debt can get out of hand for some people and they may be faced with harassing debt collection calls. Speaking with an experienced bankruptcy attorney may help stop the harassing phone calls and make sure that no fraud is committed by collectors.</p>
